These policies serve as the contract between the customer and Gailin's Sweet Treats. By submitting payment, the customer is agreeing to these policies in full. *Policies are subject to change without notice*
ALLERGENS AND LIABILITIES
Gailin's Sweet Treats cannot prevent cross-contamination in the preparation area. It is the responsibility of the purchaser to notify all consumers of allergen risks.
Gailin's Sweet Treats is to be held harmless for any allergic reactions resulting from its services.

PICK UP AND DELIVERY
Gailin's Sweet Treats is not responsible for any damage to the product after pick up or after delivery at which point the customer assumes full responsibility for the condition of the items. Gailin's Sweet Treats is not responsible for any damages to the item(s) caused by a guest, caterer, event staff, or any other person not affiliated with Gailin's Sweet Treats.
Pick-up will occur on a day and time previously agreed upon by both Gailin's Sweet Treats and the customer. The pickup time will be confirmed via email or instant message 24 to 48 hours before midday on the event date. Please plan accordingly and have a spot prepared in car for item. (Note: in the hotter months it is important to keep items away from body heat and to turn AC up.)
Delivery is available for free within 10 mi. of Millbury, MA, and is available with a fee outside that range. The maximum delivery range is 25 miles outside of Millbury, MA, unfortunately, we cannot accommodate anything farther. The total amount of the fee is based upon the distance of residence and the legal address of Gailin's Sweet Treats of Millbury, MA. The delivery fee will be no less than $10.00 but will not exceed $75.00 in total. Gailin's Sweet Treats will work with the customer as necessary, to coordinate a fair and agreed upon delivery time window.
The items should never be displayed in direct sunlight or where sunlight may eventually move to. Humidity and heat will adversely affect the items. In the warmer months (average outdoor temperature of 72°F or greater) it is encouraged to keep the items in a refrigerator, air-conditioned room, or a cooler area. Due to the effects of outdoor weather conditions, table on un-even ground, wind blowing undesirable atmospheric items (such as, but not limited to, dirt, leaves, branches, etc.), sunlight, insects, or items caused by these outdoor weather conditions or heat including, but not limited to, “sweating” (water condensation), running of colors, sliding decorations, etc.

BOOKING AND PAYMENT OF CUSTOM ORDERS
Custom orders include occasions such as birthdays, graduations, anniversaries, baby showers, bridal showers, "just because", etc.
A Custom order is not considered booked until either a 50% deposit has been submitted OR (if its a small order) you will receive a written confirmation that a deposit is not necessary and that your order is confirmed. If a deposit is necessary, it is required to be submitted no later than 7 days prior to event date. All orders must be confirmed no later than 2 weeks prior to the event date. This means if an order form must be submitted at least 2 1/2 weeks prior, to leave time for a response and to discuss the order before confirming!​

PHOTOGRAPHS AND SOCIAL MEDIA
Gailin's Sweet Treats reserves the right to take and use their own photographs of your items to use for marketing and promotional purposes without compensating the customer. Photographs of the finished and decorated items will not be posted to social media prior to the event date
FORCE MAJEURE
Gailin's Sweet Treats promises a product of high quality and service but is not liable for unforeseen circumstances including, but not limited to, inclement weather, transportation problems, illness, accidents, labor disputes or strikes, Acts of God, and other causes beyond reasonable control. A delay in transit shall not constitute grounds for a credit, discount, or refund.
